Terms of Service — PepFulfill

1. Agreement

By creating an account on PepFulfill ("we," "us," "our") or using our services, you agree to these Terms of Service. If you do not agree, do not use PepFulfill. These terms apply to all merchants (clients) who use PepFulfill to fulfill orders.

2. Research Use Only

All products fulfilled through PepFulfill are sold strictly as research chemicals for in vitro laboratory use only. They are not drugs, supplements, or medications and are not intended for human or animal consumption, diagnosis, treatment, or prevention of any condition.

As a PepFulfill merchant, you agree to:

Only sell products to verified adult researchers (18+)
Maintain all required research-only disclaimers on your store and marketing (they are also printed on every order we ship)
Comply with all applicable local, state, and federal laws regarding the sale and distribution of research chemicals in your jurisdiction
Not market products for human consumption or make health or medical claims

PepFulfill is not responsible for how end customers use the products. The merchant bears full legal responsibility for their store and customer base.

3. Account

You must provide accurate information when creating your account. You are responsible for maintaining the security of your login credentials. You may not share your account with others or allow unauthorized access. PepFulfill may suspend or terminate accounts that violate these terms or that we reasonably believe are being used for illegal purposes.

4. Fulfillment Service

PepFulfill provides order fulfillment services: we store, pack, and ship products on your behalf. Our obligations are:

Ship orders within 2 business days of receiving a paid, valid order with sufficient balance on your account
Provide tracking information upon shipment
Send order confirmation and shipping emails to your customers on your behalf

We are not responsible for carrier delays, lost packages after handoff to the carrier, or customs delays for international shipments. All orders ship within the United States only.

5. Billing & Balance

PepFulfill operates on a prepaid balance model. You must maintain a positive balance in your account. When an order is placed, we deduct the wholesale product cost plus a $3 fulfillment fee from your balance. If your balance is insufficient, the order will not be fulfilled until you add funds.

Balance top-ups are final and non-refundable. Unused balance may be refunded at our discretion upon written request and account closure. PepFulfill reserves the right to adjust wholesale pricing with 14 days' notice.

6. Prohibited Uses

You may not use PepFulfill to:

Sell products in jurisdictions where doing so is illegal
Market products for human consumption
Make medical, therapeutic, or health claims about products
Sell to minors
Remove or obscure the research-use disclaimers printed on the orders we ship
Use the platform for money laundering or fraudulent activity

Violation of these terms may result in immediate account termination and forfeiture of any remaining balance.

7. Returns & Refunds

Due to the nature of research chemicals, all sales are final. We do not accept returns or exchanges once an order has shipped. If an order arrives damaged or the wrong product was shipped, contact us within 7 days of delivery and we will investigate and, at our discretion, reship or credit your account.

8. Intellectual Property

You retain ownership of your business name and branding. PepFulfill retains ownership of the platform, technology, and all PepFulfill branding. You grant us a non-exclusive license to use your store name and logo solely to label and fulfill your orders.

9. Disclaimer of Warranties

PepFulfill is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted or error-free. We make no warranties regarding the fitness of any product for any particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, PepFulfill's total liability to you for any claims arising from these terms or your use of the service shall not exceed the balance in your PepFulfill account at the time of the claim. We are not liable for indirect, incidental, or consequential damages of any kind.

11. Indemnification

You agree to indemnify and hold harmless PepFulfill and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your store, or any violation of these terms.

12. Termination

You may close your account at any time by emailing support@pepfulfill.com. PepFulfill may suspend or terminate your account at any time for violations of these terms or for any other reason with reasonable notice, except in cases of serious violations where immediate termination may occur.

13. Governing Law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.

14. Changes

We may update these terms at any time. We will post the updated date above and notify active clients by email of material changes. Continued use of PepFulfill after an update constitutes acceptance.
